These Terms and Conditions (“Terms”) govern your access to and use of the HireLoft Recruitment website and services. Your use of this site or services acquires you the agreement to these Terms. In case you disagree with any of these Terms, you are advised to stop using our website and services instantly.

About HireLoft

HireLoft Recruitment is a professional recruitment and staffing firm that offers its services to other firms in terms of candidate sourcing, screening, and placement assistance in various industry segments. HireLoft is just the mediator between the employer and the job applicant. We do not hire candidates on behalf of our clients and have no liability for the establishment of an employment relationship between a client and a candidate. The employer makes all the hiring decisions and employment arrangements independently.

Use of Services

Our services are intended strictly for lawful recruitment and employment purposes. By using this website, you agree to act in good faith and in accordance with applicable laws and regulations. HireLoft reserves the right to restrict or terminate access to its services at its sole discretion if any misuse, unlawful activity or violation of these Terms is identified.

Employer Responsibilities

Employers who engage HireLoft agree to provide accurate, complete and lawful job information and to use candidate information solely for recruitment purposes. Employers are responsible for ensuring compliance with all applicable employment, labour and privacy laws. HireLoft does not assume responsibility for the accuracy of job descriptions or the conduct of employers during or after the hiring process. Employers are solely responsible for evaluating candidates, conducting interviews and making final hiring decisions.

Candidate Responsibilities

Applicants must present correct, recent, and honest information when they send their information to HireLoft. We can also remove any false, misleading, or incomplete information and withdraw consideration or access to our services. Although HireLoft is focused on matching candidates to the opportunities they want, we do not promise employment, interviews, or particular results. It is the duty of the candidates to evaluate job opportunities and employers on their own.

Use of Candidate Information

All candidate information shared through HireLoft is considered confidential and is provided exclusively for recruitment purposes. Clients are not permitted to share, distribute, or retain candidate information beyond the scope of the recruitment process without prior consent. Any attempt to contact candidates outside of the recruitment process facilitated by HireLoft, or to use candidate data for purposes unrelated to hiring, is strictly prohibited. Misuse of such information may result in immediate termination of services and further action where appropriate.

Fees and Placement Terms

Recruitment fees are applicable in accordance with agreements between HireLoft and the client. A fee becomes payable when a candidate introduced by HireLoft is hired, whether directly or indirectly. This is not limited to situations where the hiring is done outside of the original hiring process, but the introduction was made through HireLoft within a reasonable timeframe. Any default of payment terms agreed can lead to suspension or termination of services along with payment of outstanding.

Confidentiality

All parties agree to maintain the confidentiality of information exchanged during the recruitment process. This includes but is not limited to candidate profiles, employer data and any proprietary or business-related information. Such information must not be disclosed to third parties without prior consent unless required by law.

No Guarantee of Outcomes

HireLoft does not guarantee the suitability, availability, or performance of any candidate. Similarly, we do not guarantee that candidates will secure employment through our services. All information provided by candidates or clients is relied upon as submitted and HireLoft does not independently verify all details. Clients are responsible for conducting their own due diligence before making hiring decisions.

Limitation of Liability

HireLoft will not be responsible to the maximum extent allowed by law for any direct, indirect, incidental or consequential losses due to the use of our services. This comprises but is not limited to losses in hiring decisions, employment outcomes or dependency on information offered on the platform. Our services are provided on an as-available basis without any express or implied warranties.

Indemnification

Using our services, you hold HireLoft Recruitment, its affiliates, employees and representatives free of all claims, damages and other liabilities that can arise when you use the site, violate those Terms or are violated by the current laws and regulations.

Termination

HireLoft has the right to suspend or cancel the use of its services at any time and without prior notice in case of the violation of these Terms, misuse of information, or failure to meet payment obligations. The customers have the freedom to terminate their use of our services as well.

Data Privacy

The personal information that HireLoft collects and processes is collected and processed within the confines of the relevant privacy laws in Canada, which include PIPEDA. You agree to the collection, use and sharing of the information required to support recruitment activities by utilising our services.

Changes to These Terms

HireLoft may update these Terms from time to time to reflect changes in our services or legal requirements. Revised Terms will be uploaded on this page with a new date. The fact that we update our website or services will deem acceptance of the revised Terms.

Governing Law

These Terms will be regulated by and understood as per the laws of the Province of Ontario, Canada. The courts of Ontario shall have the sole jurisdiction over any dispute that may arise as a result of these Terms.
